Terms of Use
1. Agreement
These Terms of Use ("Terms") are a binding agreement between you and the operator of Warp Gate ("we", "us"). By ticking the acceptance box, opening a gate, joining a gate, or otherwise using Warp Gate (the "Service"), you confirm that you have read, understood and agree to these Terms, to the Acceptable Use Policy and to the Privacy Policy. If you do not agree, do not use the Service.
You confirm that you are of legal age to form a binding contract in your jurisdiction, and that you are not barred from using the Service under any applicable law.
2. What the Service is
Warp Gate creates temporary, end-to-end encrypted connections between web browsers. A session seats a small number of devices; once connected, messages and files pass directly between those devices. The Service exists only to introduce the devices to each other.
There are no accounts. Sessions are deliberately short-lived and are destroyed when they expire, when any participant ends them, or when the server restarts.
3. You are responsible for your use of the Service
You are solely responsible and liable for everything you send, receive, request, store or otherwise do using the Service, and for all consequences of doing so. This includes, without limitation:
- the lawfulness of all content you transmit or receive;
- your right to transmit that content, including any intellectual property, privacy, confidentiality or contractual rights of any other person;
- your choice of who to share a gate link with, and everything that person then does with the link or with anything you send them;
- compliance with all laws, regulations and export controls that apply to you.
Because content is encrypted end-to-end, we do not and cannot see, review, moderate, scan, filter or retain what you transmit. You accept that responsibility for that content rests entirely with you and that we exercise no editorial control over it.
4. Prohibited use
You must not use the Service in breach of the Acceptable Use Policy, which forms part of these Terms. You must not use the Service for any unlawful purpose, nor to attack, overload, probe, reverse engineer, or interfere with the Service or the infrastructure it runs on, nor to circumvent any limit, rate control or security measure.
5. No warranty
The Service is provided "as is" and "as available", with no warranties or conditions of any kind, whether express, implied or statutory, including without limitation any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, or uninterrupted or error-free operation.
Without limiting the above, we do not warrant that a connection will succeed, that a transfer will complete, that data will arrive intact, that the Service will be available at any time, or that any security property will be effective against any particular adversary. The Service is not a backup service and retains nothing: if you do not save what you receive, it is gone.
6. Limitation of liability
To the maximum extent permitted by applicable law, we will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, nor for any loss of data, loss of profits, loss of business, loss of goodwill, business interruption, or the cost of substitute services, arising out of or in connection with your use of or inability to use the Service, whether based in contract, tort (including negligence), strict liability or any other theory, and whether or not we have been advised of the possibility of such damages.
To the maximum extent permitted by applicable law, our total aggregate liability arising out of or relating to the Service will not exceed the greater of (a) the total amount you paid us to use the Service in the twelve months preceding the claim, which for a free service is nil, or (b) ten Canadian dollars (CAD 10).
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages. Where such law applies, the above exclusions and limitations apply to the fullest extent that law permits, and nothing in these Terms limits liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot lawfully be limited.
7. Indemnity
You agree to indemnify, defend and hold harmless the operator of the Service and any person involved in providing it against any claim, demand, proceeding, loss, liability, damage, fine, penalty, cost or expense (including reasonable legal fees) arising out of or related to: (a) your use of the Service; (b) any content you transmit or receive through it; (c) your breach of these Terms or the Acceptable Use Policy; or (d) your violation of any law or of the rights of any third party.
8. Availability, suspension and changes
The Service is provided free of charge and on a best-effort basis. We may change, suspend, limit, restrict access to, or discontinue the Service or any part of it at any time, for any reason, without notice and without liability to you. We may impose rate limits, capacity limits, size limits and session time limits, and may block access from any network or address.
We may amend these Terms at any time by publishing an updated version on this page. Continued use of the Service after a change takes effect constitutes acceptance of the updated Terms.
9. Severability and waiver
If any provision of these Terms is held unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, or severed if it cannot be, and the remaining provisions will continue in full force. A failure to enforce any provision is not a waiver of it.
10. Governing law
These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable in it, without regard to its conflict of law rules. You agree to the exclusive jurisdiction of the courts located in Edmonton, Alberta, subject to any mandatory consumer protection rights you have in your place of residence.
